Please read these conditions carefully before ordering any goods through martinwoodcockphotography Website. By placing an order via this Website, you agree to be bound by these conditions.

All images/articles contained on this site are subject to UK Copyright Laws. The 1988 Copyright Design and Patents Act section 77 & 80 assigns the copyright of the photographs taken to the photographer/studio. It is contrary to the Act and an offence to copy or allow to be copied, the photographs taken by martinwoodcockphotography by any means and may lead to prosecution. All images and articles on this site remain the property of martinwoodcockphotography at all times.
No images may downloaded or used without express permission from martinwoodcockphotography
for any purpose whatsoever.
Martinwoodcockphotography reserve the right to make changes to our website, policies and these terms and conditions. You agree to be subject to the Terms and Conditions in force at the time you placed your order.
Your attention is specifically drawn to clause 6 which limits martinwoodcockphotography
liability to you:-
1. ACCEPTANCE OF ORDER
1.1 When you place an order with martinwoodcockphotography
our website you are making an offer to martinwoodcockphotography
which we may accept or decline. Receipt of payment by martinwoodcockphotography
does not mean that we have accepted your order and we reserve the right to return your payment to you if your order is not accepted. We will confirm acceptance of your order by sending an e-mail to you at the e-mail address you provide on your order form. Any goods on the same order which we have not confirmed in the dispatch confirmation email will not form part of that contract.
1.2 Before placing any order for delivery outside of the UK, you must send an e-mail to us with details of your delivery address. Your order will not be accepted unless we have confirmed to you that we are willing to make delivery to that address.
2. PRICES
2.1 The prices on martinwoodcockphotography website exclude delivery costs and are subject to change. You will be notified of any change in the prices of ordered goods prior to any acceptance of your order.
2.2 We reserve the right, by giving notice to you, at any time before delivery to increase the price of the goods to reflect any increase in costs to us which is due to any factor beyond our control (such as, without limitation, any foreign exchange fluctuation, significant increases in costs of delivery or costs of production). In the unlikely event of there being such an increase in the price of goods, you shall, following notice, be entitled to cancel the order at any time before delivery.
2.3 martinwoodcockphotography Delivery charge is specified on the website and will be added automatically to your order dependent on the goods ordered and the delivery address you have supplied.
2.4 Payments will only be accepted in sterling (GBP) and, unless otherwise agreed by martinwoodcockphotography, payment for the full amount must be received by martinwoodcockphotography before your order can be processed. No payment shall be deemed to have been received by martinwoodcockphotography until it has received cleared funds.
2.5 Orders can be made:
2.5.1 Online: Direct on our Website with the on-line basket with a Debit / Credit card. We currently accept Visa, MasterCard, Switch and Solo.
2.5.2 By Phone: and pay by cheque / Debit / Credit card
2.5.3 By Post: and pay by cheque / Debit / Credit card
2.5.4 In the unlikely event that your credit / debit card is not authorised martinwoodcockphotography will contact you immediately.
3. AVAILABILITY
3.1 All orders are subject to availability of goods. If martinwoodcockphotography are unable to deliver the goods ordered by you we will notify you by e-mail and credit the price and the delivery charges of the unavailable goods to your credit/debit card within 28 days of your order.
4. DELIVERY
4.1 martinwoodcockphotography will endeavour to deliver most items within 10 working days from the acceptance of your order. If for any reason, there is a delay of more than 30 days from the date your order was placed, we will inform you by email and give you the option of cancelling your order. Should you choose to cancel your order, you will receive a full refund.
4.2 You acknowledge that martinwoodcockphotography rely totally upon the accuracy of the information which you have provided us with for delivery. You will not become the owner of the goods until they have been delivered to you, at which time the goods will become your risk and martinwoodcockphotography will not be liable for any subsequent damage, loss or destruction to them. Unless specifically agreed by martinwoodcockphotography in writing, orders can only be delivered within the UK.
4.3 You must inspect the goods as soon as is reasonably practicable after delivery, and notify martinwoodcockphotography of any shortages, defects or damage to the goods within 14 days from the date the goods were delivered. martinwoodcockphotography shall not be liable in respect of any complaint which should have been brought to its attention within this period.
4.4 martinwoodcockphotography will use all reasonable endeavours to carry out its obligations, but will not be liable to you for any loss, costs or expenses arising directly or indirectly from any delays in doing so and martinwoodcockphotography will not be deemed to be in breach of these Terms and Conditions by reason of a delay in performing, or any failure to perform any of our obligations in relation to this agreement, if the delay or failure was due to any cause beyond our reasonable control. If martinwoodcockphotography are prevented from carrying out our obligations under these circumstances, we will notify you in writing.
If martinwoodcockphotography is still prevented from carrying out its obligations 30 days from the date such notice was sent, then either party may give written notice to the other, cancelling this agreement. If the agreement is cancelled under this clause martinwoodcockphotography accept no liability to compensate you for any loss or damage caused by its failure to perform in excess of refunding any payment made by you.
5. RETURNS
5.1 Goods may be returned by registered postage provided that you return the item to martinwoodcockphotography in an unused state within 14 working days from the date of Delivery together with your martinwoodcockphotography receipt (this does not affect your statutory rights).
5.2 Any returns are subject to the following:
5.2.1 Notification to martinwoodcockphotography by email of your intention to return the goods by registered post.
5.2.2 The goods must be in their original condition and not be damaged or tampered with in any way or missing any parts.
5.2.3 Any goods to be returned must be received by martinwoodcockphotography no later than 30 days after you receive the returns slip. Returning unwanted items is to be at your risk and expense, unless we delivered the goods in error, or the goods are faulty.
5.2.4 martinwoodcockphotography will credit the price of the returned goods to your credit/debit card within 28 days of receipt of the returns in an unused state. If the goods are defective or incorrect then in addition your delivery charges will be refunded.
6. COMPLAINTS AND LIABILITY
6.1 IF THE GOODS martinwoodcockphotography DELIVER TO YOU ARE NOT AS ORDERED OR ARE DAMAGED, DEFECTIVE OR OF INCORRECT QUANTITY OUR LIABILITY SHALL BE LIMITED TO REPLACING THE DAMAGED OR DEFECTIVE GOODS OR MAKING GOOD THE SHORTFALL IN QUANTITY OR AT OUR OPTION CREDITING THE PRICE AND DELIVERY CHARGES OF THOSE GOODS TO YOUR CREDIT/DEBIT CARD. martinwoodcockphotography SHALL NOT BE LIABLE TO YOU FOR FAILURE TO DELIVER GOODS ORDERED BY YOU UNLESS YOU NOTIFY US WITHIN 42 DAYS OF THE DATE OF YOUR ORDER. OUR LIABILITY SHALL BE LIMITED TO DELIVERING THE GOODS ORDERED OR AT OUR OPTION CREDITING THE PRICE AND DELIVERY CHARGES OF THE NON-DELIVERED GOODS TO YOUR CREDIT/DEBIT CARD.
6.2 Nothing in these Conditions excludes or limits the liability of the Company:
6.2.1 for death or personal injury caused by martinwoodcockphotography’s negligence;
6.2.2 under section 2(3) Consumer Protection Act 1987;
6.2.3 for any matter which it would be illegal for the company to exclude or attempt to exclude its liability; or
6.2.4 for fraud or fraudulent misrepresentation.
6.3 Subject to conditions 6.1 and 6.2:
6.3.1 martinwoodcockphotography’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this order shall be limited to the price of the goods; and
6.3.2 martinwoodcockphotography shall not be liable to the Buyer for any pure economic loss, loss of profit, loss of business, depletion of goodwill or otherwise, in each case whether direct, indirect or consequential, or any claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with the order.
6.4 THIS DOES NOT AFFECT YOUR STATUTORY RIGHTS.
7. VARIATIONS
7.1 No variation to these Conditions shall be binding unless agreed in Writing.
Our employees or agents are not authorised to make any representations concerning our goods unless they are confirmed by martinwoodcockphotography in Writing. You acknowledge that you are not relying on any such representations which are not confirmed in Writing.
7.2 If any clause of these Terms and Conditions is unenforceable it shall not effect the enforceability of the rest of these Terms and Conditions.
7.3 Any typographical, clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued on the website shall be subject to correction without any liability on the part of martinwoodcockphotography.
7.4 martinwoodcockphotography reserve the right to refuse to supply any individual or company at our absolute discretion.
8. ABOUT US
8.1 martinwoodcockphotography hope your visit will be simple and efficient. A password will be issued for our online albums by request. This password will enable your details to be kept private and you should keep it confidential and not disclose it to any third party.
9. GOVERNING LAW
9.1 As the Internet allows access to the site from countries acting under different laws differing from those of the company (anywhere outside England and Wales), you agree that insofar as is allowed by any relevant legislation or jurisdiction English law shall govern this contract.
